​PATIENT INFORMATION TEXT WITHIN THE SCOPE OF THE PERSONAL DATA PROTECTION LAW

As Özel Dent Gebze Oral and Dental Health Ltd. Şti., within the framework of our information obligation under the Law on the Protection of Personal Data No. 6698 (“KVKK”), as the Data Controller, considering the data security of patients and their relatives, due to the importance we attach to the protection of privacy, fundamental rights and freedoms, we would like to inform you about the purposes of processing your personal data, legal reasons, collection method, to whom it can be transferred and the rights granted to you under the KVKK.

 

1. Which Personal Data Do We Process?

In order to provide health services to our patients, we collect various personal data in accordance with the principles and conditions included in the KVKK and other relevant legislation (Private Hospitals Regulation, Regulation on Personal Health Data, etc.). In order to provide health services to our patients, the following data is collected by the treatment center from our patients, from other health institutions and organizations or from the relatives of the patient for the purpose of conducting medical diagnosis, examination, treatment and care services:

· Name, surname, telephone, signature, address information of up to 3 relatives of the patient,

· Your name, surname, signature,

· Your T.R. identity information, ID or driver's license photocopy, passport number,

· Your date of birth,

· Your gender,

· Your address,

· Your telephone number,

· Your e-mail address,

· Özel Dent Gebze Oral and Dental Health Ltd. Şti. Your patient protocol number and other identification data that we can use to identify you,

· Your financial data regarding payment and billing,

· Your data specified in the consent form that you may provide in the event of a medical intervention,

· Your private health insurance or Social Security Institution data for the financing and planning of health services,

· Your general and special personal data, especially personal health data obtained during the execution of all medical diagnosis, examination, treatment and care services, such as your laboratory results, test results, examination data, prescription information,

· Your closed circuit camera system images and recordings during your visit to our Treatment Center,

· Your association, foundation or union membership information, (If you want to benefit from the discount)

· Your survey, suggestion, thank you and complaint data,

· Other data you share when you reach us via e-mail, website contact form, telephone or other channels.

· Physical status information such as height and weight,

2. For what purposes do we process your personal data?

Your personal and special personal data listed above;

· Fulfilling our legal obligations stipulated in the Health Services Fundamental Law No. 3359, the Decree Law No. 663 on the Organization and Duties of the Ministry of Health and its Affiliated Institutions, the Public Health Law No. 1593, the Patient Rights Regulation, the Private Hospitals Regulation, the Regulation on Personal Health Data and other relevant legislation;

· Protection of public health, preventive medicine, medical diagnosis, treatment and care services, planning and management of health services and financing;

· Providing you with information about your appointment if you make an appointment;

· Planning and managing the internal operations of Özel Dent Gebze Oral and Dental Health Ltd. Şti.;

· Register to the e-pulse system;

· Benefit from the current discounts of our treatment center according to the association, foundation or union you are a member of;

· Analyze in order to improve our services;

· Billing;

· Verify your identity;

· Monitor and prevent abuse and unauthorized transactions;

· Plan and manage the internal procedures of our Treatment Center

· Perform risk management and quality development activities;

· Conduct research,

· Respond to all your questions and complaints regarding our health services;

· Ensure financial agreements with contracted institutions regarding the health services provided to you;

· Respond to the requests of the Ministry of Health and other public institutions and organizations in accordance with the applicable legislation;

· Respond to your questions or complaints regarding our services;

· Analyze your use of health services in order to improve the services we provide;

· Comply with the internal policies and principles of Özel Dent Gebze Oral and Dental Health Ltd. Şti.;

· Measuring patient satisfaction and increasing patient satisfaction following your receipt of health services;

· Contacting you for informational purposes regarding our services;

· Provision of medicines or medical devices, 

to be processed, recorded, stored, preserved, classified for the purposes of public security and legal disputes that may arise, to provide information to prosecutors, courts and relevant public officials upon request and as required by law; and when necessary, within the scope of the purposes stated above, it may be transferred to authorized public institutions and organizations, medical secretaries, floor secretaries, laboratories with which we cooperate for medical diagnosis, private insurance companies, law offices, e-pulse system, medula system and financial advisors.

3. What are the Collection Methods of Your Personal Data and the Legal Reasons Related to Them?
Your personal data mentioned above may be processed within the scope of the purposes specified in this Information Text for the following reasons: (i) it is clearly foreseen in the laws, (ii) it is directly related to the establishment or execution of a contract, and the processing of personal data belonging to the parties to the contract is necessary, (iii) it is mandatory for the protection of the life or physical integrity of the person who is unable to give his/her consent due to a de facto impossibility or whose consent is not legally valid, or of another person, (iv) it is mandatory for the data controller to fulfill its legal obligation, (v) it is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the relevant person, (vi) for the protection of public health, preventive medicine, medical diagnosis, treatment and care services, planning and management of health services and their financing; a) To be in compliance with the law and rules of honesty,
b) Provided that it is accurate and up-to-date when necessary,
c) For specific, clear and legitimate purposes,
d) In connection with the purpose for which it is processed, limited and proportionate,
e) To be processed, recorded, stored, preserved, classified and transferred by automatic means (e.g. camera recordings) or non-automatic means (e.g. forms filled out by you) provided that it is part of any data recording system, for the period required for the purpose for which it is processed or for which it is processed.

4. What are your rights regarding the processing of personal data and how can you access these rights?

It is stated in Article 20 of the Constitution that everyone has the right to be informed about personal data concerning him/her. Article 11 of the LPPD lists the rights of the personal data owner under the law.

You can submit your requests regarding your rights within the scope of the LPPD to Özel Dent Gebze Oral and Dental Health Ltd. in accordance with Article 5 of the “Communiqué on the Procedures and Principles of Application to the Data Controller”. You can send it to Şti. in writing or by using the registered electronic mail (KEP) address, secure electronic signature, mobile signature or the electronic mail address previously notified to the data controller by the relevant person and registered in the data controller's system.
